Data protection officer

We have not appointed a data protection officer. Whether one is required is still being decided. If we appoint one, their contact details will appear here.

What this website asks you for

The appointment form asks for seven things: your name, a telephone number with its country code, an email address, the language you would like to be seen in, the reason for the visit, the time of day that suits you best and how you would rather we got back to you (call, WhatsApp or email).

That is all. We do not ask for an ID number, an address, bank details or a card. Nothing is paid for here.

When you press send, the request leaves your browser for a program of ours, on our own server, which turns it into an email and sends it to us. Your email app and your WhatsApp are not opened, and there is nothing else for you to do. That program stores your request nowhere: the only copy that exists is the one in our mailbox.

The chat assistant on this site sends nothing by itself: it drafts a WhatsApp message that you send, from your own app. That message passes through WhatsApp Ireland Ltd. (Meta group) under its own terms, which include processing outside the European Union. If you would rather not use it, there is the form, email, the phone and the counter.

You can also book by phone. In that case we keep what you tell us, for the same purpose and for the same length of time.

What this site keeps in your browser

No cookies at all. The chat assistant keeps two notes in your browser’s session memory — whether you closed it and the language you chose — and they delete themselves when you close the tab. They identify nobody and never leave your device. If you answer the permissions notice, your answer is also stored in your browser, for at most 24 months. The cookie policy sets it out in detail.

The online hearing check collects nothing

The hearing check on this site runs entirely inside your browser. The sounds and your answers never leave your computer or phone: nothing is sent to any server, ours or anyone else’s.

We do not ask for your email before showing you the result, we do not store it, and it is not attached to any name. If you want us to see it, you will have to bring it in or tell us about it.

What we use your data for, and on what legal basis

Each purpose has its own legal basis. We do not blur them together:

  • Arranging, confirming or reminding you of an appointment: pre-contractual steps and performance of the service contract, article 6(1)(b) GDPR.
  • Answering what you ask by phone, email or WhatsApp: our legitimate interest in replying to people who contact us, article 6(1)(f).
  • Invoicing and meeting tax and healthcare obligations: legal obligation, article 6(1)(c).
  • Sending you offers or check-up reminders: only with your express consent, article 6(1)(a), which you may withdraw at any time.

Your prescription and your audiogram are health data

What we measure in the consulting room — your prescription, your eye pressure, your audiogram, your speech understanding — is health data. Article 9 GDPR treats it as a special category and gives it stronger protection.

That data is not processed on the basis of your marketing consent. It has its own legal basis: article 9(2)(h) GDPR, which allows health data to be processed for care provided by a professional bound by professional secrecy, together with Spanish Law 41/2002 on patient autonomy.

In practice that means three things: it lives in your clinical record, not in the marketing file; only the professional treating you can see it; and it is covered by professional secrecy.

And a fourth, the one we most want you to take away: agreeing to be examined is not agreeing to receive advertising. They are two separate permissions and we ask for them in two separate boxes. Leave the advertising box empty and the care you receive is exactly the same.

How long we keep it

These are the periods we apply:

  • Your clinical record: at least five years from the end of each episode of care, as required by article 17 of Spanish Law 41/2002.
  • Invoices and accounting records: for as long as Spanish tax law and the Commercial Code require.
  • An appointment request that never becomes a visit: one year, then deleted.
  • Your consent to receive advertising: until you withdraw it.

Who else sees it

We do not sell your data and we do not pass it to anyone for commercial purposes. Ever.

We disclose it in two situations only. First, where the law requires it: the tax authority, health authorities, the police or the courts. Second, where your own care requires it: if your lens or your hearing aid is made off site, the laboratory receives only the technical data needed to make it, and a warranty claim sends the manufacturer the bare minimum.

The Indo Optical video that opens the home page is hosted on YouTube, which belongs to Google Ireland Limited. If you accept, or if you press play, Google receives your IP address and stores information in your browser. Until one of those happens, nothing is asked of Google: the image you see sits on our own server. Google may process data in the United States, under the adequacy decision of the EU–US Data Privacy Framework of July 2023.

The same goes for the manufacturer videos included in some advice articles, also hosted on YouTube: they never load on their own, and until you press their play button nothing is asked of Google. The cookie policy lists them.

No third-party service is involved in the appointment form. It is received by a program of our own, on our own hosting, which turns your request into an email and stores it nowhere: no database, no copy on disk, no log of the contents.

That hosting is a processor, and it is IONOS (1&1 IONOS España S.L.U. (CIF B85049435), Alcobendas, Madrid), the same one that already hosted our previous websites. Its servers are in the European Union.

We use no third-party anti-bot system. The form is protected by a hidden field that calls nobody: booking an appointment stores nothing in your browser and needs no permission.

That same hosting also serves this website. The shop's practice management software will be listed here by name and country once our adviser has reviewed the contract; we do not publish half a list. If any supplier processed data outside the European Union, that would be stated here explicitly.

Your rights

You can ask us for any of the following:

  • Access: to know what we hold about you and to receive a copy.
  • Rectification: to correct anything wrong or incomplete.
  • Erasure: to delete what we no longer have reason to keep.
  • Objection: to stop using your data for a particular purpose.
  • Restriction: to keep it but not use it while a disagreement is resolved.
  • Portability: to take your data away in a format another professional can read.
  • Withdrawal of your advertising consent, with no effect on any of the above.

How to ask

Write to hola@modalent.es or to Calle Hernán Cortés, 2 · 30860 Puerto de Mazarrón · Murcia, Spain, or simply tell us at the counter. Say which right you want to exercise and enclose a copy of an identity document: that is how we make sure we never hand one person’s data to someone else.

We reply within one month. There is no charge.

If you think we are getting it wrong

Tell us first: almost everything is sorted out in a conversation.

If you are still not satisfied, you have the right to complain to the Spanish Data Protection Agency (AEPD), calle Jorge Juan 6, 28001 Madrid, www.aepd.es. Complaining is free and you do not need a lawyer.

Changes to this policy

If what we do with your data changes, this text changes. The version on this page is the one that applies. This text was written in August 2026.
